Property Rights in France – Trees and Shrubs

We release today a new section of our Guide to Property Rights in France, with a review of your rights and responsibilities concerning trees and shrubs.

In the guide we review the law concerning the minimum distances between properties for trees and shrubs.

We consider the rights of an owner concerning overhanging branches, including pruning rights.

We also consider problems in relation to blocked gutters from neighbouring overhanging trees, as well as the law on fallen trees, and shading caused from a neighbouring tree.

Finally, we review the dispute procedures, in the event you cannot resolve the problem amicably with your neighbour.
