Guide to Noise Nuisance Complaints in France

We are pleased today to announce the release of our guide to dealing with noise nuisance problems in France.

Sadly, noise nuisance is a growing part of all of our lives, even sometimes in the rural tranquility of France, where solutions to the problem are no easier than they are anywhere else.

If you are a victim of noise nuisance then you have the right of recourse to both criminal and civil law but, as the criminal sanctions are weak, it is also often necessary to pursue a civil action alongside, or instead of, criminal proceedings.

In our guide, we review the problems and solutions available in relation to both domestic noise nuisance and noise caused from commercial activities.

The Government have recently strengthened the law in relation to noise from commercial activities, but as yet there is very little case law on the impact of these new controls.

Consequently, as is frequently the case in France, it pays to keep a good record of events, and to work alongside neighbours to generate political pressure on the local Mayor and officials.

As an alternative to legal or political action, there is also a range of official mediation services that are available, and which are often worth considering.
